The Cooling Off Period

The cooling off period provides the parties in opposition proceedings the opportunity to negotiate a settlement before the commencement of the adversarial stages of an opposition. The intention is to allow the parties the opportunity to reach a settlement and save time and costs.

The cooling off period lasts for three months and may be further extended by one, three month period. Both parties to proceedings must agree to any request to enter/extend the cooling off period.

To enter or extend the cooling off period, you must:

  • have the agreement of the other party to the proceedings to the request
  • file the appropriate form, mentioned below.
