Restoration
If you fail to renew
your mark in the six months after the renewal date, there is a further
six-month period, i.e. a total of up to one year after the renewal
date, in which you may apply to restore your mark.
The restoration application should be supported with
a statement explaining the reasons for failure to renew in due time.
The Registry must be satisfied that there are valid
and sufficient reasons for your failure to renew, we will:
- restore your mark to the register, and
- send you a Renewal Certificate confirming that
we have renewed your mark for the next ten-year period, i.e. from
the original renewal date.
If we are not satisfied with your reasons for failure
to renew, we will:
- write and explain why we have not accepted them,
- refund any renewal fees you have paid,
- not refund the £100 restoration fee.
Your mark will then be REMOVED from the Register of
Trade Marks.
