Registrable transactions
Anyone who claims to have an interest in or under
a registered trade mark may apply to have the details of that claim
entered onto the Register of Trade Marks. Such claims usually stem
from:
- the person being granted a security interest, e.g.
a mortgage or debenture, over the mark;
- but may also result from:
o the making by personal representatives of an assent for
the mark;
o a court or other competent authority transferring the
mark.
Note: Assignments
and licences
are also registrable transactions, but are dealt with separately.
