Dividing an application

You may divide an application into two or more separate applications (called divisional applications) by sending the form mentioned below, indicating for each division the specification of goods or services to be covered.

This action is usually necessary when objections have been raised at examination to:

  • an application for a series of marks. Division allows those marks which are acceptable to go forward for publication, and for objections to the remaining marks to be dealt with in more detail at a later date.
  • some of the classes in a multi-class application. Division allows those classes which are acceptable to go forward for publication, and for objections to the remaining classes to be dealt with in more detail at a later date.

If divisional applications are later registered, it is possible to combine them into one registration by merging. This has the advantage of reducing renewal fees.
