Caveats

A caveat is a warning, or notification, that some action has taken place on a trade mark application or registration. The most common reason for filing a caveat is to be informed when an application reaches the stage of advertisement in the Trade Marks Journal, or if the application falls before advertisement.

You may ask the Office to notify you of any of the following events/actions:

  • application published, or withdrawn, refused or deemed abandoned before publication;
  • opposition filed against an application;
  • application registered, or withdrawn, refused or abandoned after publication;
  • registration not renewed;
  • registration renewed or expired;
  • registration surrendered or revoked;
  • assignment application received;
  • mark assigned, either partially or in full;
  • anything else.

When the action has taken place, the Registry will write to tell you, and remove the caveat from the case file.

The application must be submitted with a fee sheet, which must be filled with all fee bearing forms.
